In the area of insolvency, the firm represents creditors, debtors and trustees.  The firm has substantial experience in handling commercial debt recovery and litigation, valuation disputes at auction stage, negotiating cash collateral agreements and representing creditors in those transactions.  Additionally, the firm is experienced in defending creditors in receivership or liquidation proceedings, brought by debtors or trustees to recover preferential or fraudulent transfers.

In bankruptcy matters, our creditor clients appreciate our efficient and practical approach to handling these matters as the firm is always considering potential costs and expenses in light of the debtor’s limited resources available for recovery.

Commercial Litigation

Caribbean Commercial & IP Law Practitioners has substantial experience in Commercial Litigation and contract disputes.  In this area, the firm represents corporate entities as well as business owners and individuals.  We handle all types of business disputes including contract disputes, corporate and partnership litigation, as well as cases involving claims of slander, tortious interference with existing and potential business relationships, breach of fiduciary duty, fraud and negligent misrepresentations.

The firm also handles real estate litigation matters, including title actions, auctions, foreclosures and receiverships.

Construction Litigation

The firm represents owners, contractors and subcontractors in breach of contract claims, termination disputes, lien disputes, liquidated damages claim, congeneration claims of extra work, equitable adjustment and negligent design claims.  We also assist our clients in drafting proper construction contracts prior to commencement of the project.

Commercial Loan Transactions

The firm has considerable experience in syndicated and cross border loan transactions and has advised in and participated in the drafting of complex loan transaction documents including guarantees, administrative and collateral agency agreements, mortgage debentures.

Caribbean Commercial & IP Law Practitioners also handles loan transactions including the grant of original mortgage, refinancing, loan modifications, renewals and loan closings.

Creditor's Rights

The firm’s primary litigation focus is in the area of Creditor’s rights, representing financial institutions, companies with acquired loan portfolios and commercial landlords.  The majority of the firm’s cases involve commercial debt recovery and lease payment defaults, including foreclosures, receiverships, evictions, lawsuits on personal guaranties, garnishments and other judgment recovery forms. 

We have successfully defended lender’s liability and insolvency adversary claims for our clients.  We have unique and substantial experience with loan portfolios for recovery acquired from the many lending financial institutions like the Commercial Banks and Credit Unions we represent.

Landlord/Tenant

Caribbean Commercial & IP Law Practitioners LLP primarily represents Commercial landlords in property management issues and Landlord/Tenant disputes.  As Real Estate attorneys, we have several national businesses, private real estate owners, handling all of their landlord/tenant matters at multiple properties throughout the country.  The firm also has experience representing both landlords and tenants in the Courts and review of letters before acting including estoppel letters when disputes arises between the landlord and the tenant.

Outside of litigation, we advise clients on potential management issues as well as the negotiation and drafting of leases.
